Returns & cancellation
Your right to cancel
You have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right to cancel, you must inform us — Tocommons Ltd, 128 City Road, London, EC1V 2NX, contact@tocommons.co.uk — of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model cancellation form, but it is not obligatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
Effects of cancellation
If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.
We will make the reimbursement without undue delay, and not later than 14 days after the day we receive back from you any goods supplied, or (if earlier) 14 days after the day you provide evidence that you have returned the goods. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods to us at Tocommons Returns, 131 Seaforth Avenue, New Malden, Surrey, KT3 6JW without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Sealed hygiene products
Many of our products are skincare and cosmetics that are sealed for health protection or hygiene reasons. You lose the right to cancel sealed goods which are not suitable for return due to health protection or hygiene reasons if they become unsealed after delivery (Consumer Contracts Regulations 2013, regulation 28(3)(a)). "Sealed" means the product had a seal when we delivered it (for example cellophane or shrink-wrap, a seal sticker, or foil under the cap) and that seal has since been broken. Opening only the outer box, or opening a product that had no seal, does not count. You can still inspect the outer packaging and return unopened, sealed products within the 14-day period. This does not affect your rights if the product is faulty or not what you ordered.
Faulty goods
We are under a legal duty to supply goods that are in conformity with the contract. If a product is faulty, not as described, or not fit for purpose, you have rights under the Consumer Rights Act 2015 that are separate from the right to cancel above. Within 30 days of delivery you can reject the product and receive a full refund. After 30 days you are entitled to a repair or replacement, and if that is not possible or does not work, a refund (which may be partial after the first six months). If you return a product because it is faulty, not as described or not what you ordered, we will pay the cost of returning it: contact contact@tocommons.co.uk with your order number and we will send a label, or keep your postage receipt and we will refund it.
Complaints
If you are unhappy with our service, email contact@tocommons.co.uk and we will get back to you as soon as possible.
